These Terms and Conditions of Sale (\u201cTerms\u201d) apply to orders placed through the website www.isadora-boutique.ch<\/a><\/strong>, operated by Isadora Boutique<\/strong>, a business registered in Switzerland under number CHE-247.909.611<\/strong>, with its registered office in Neuch\u00e2tel, Switzerland.<\/p>\n

1. SCOPE OF APPLICATION<\/h2>\n

1.1 <\/strong>These Terms apply to all orders for products placed through the website www.isadora-boutique.ch<\/a>. They govern the contractual relationship between the customer and Isadora Boutique. <\/p>\n

Any terms or conditions proposed by the customer that conflict with or deviate from these Terms shall not apply unless expressly accepted in writing by Isadora Boutique in advance.<\/p>\n

1.2<\/strong> For the purposes of these Terms, the term \u201ccustomer\u201d refers to any natural person placing an order primarily for private purposes and not in connection with any professional or commercial activity.<\/p>\n

1.3 <\/strong>Unless otherwise stated, any time limits expressed in business days refer to Monday to Friday, excluding applicable public holidays.<\/p>\n

2. CUSTOMER ACCOUNT AND INFORMATION PROVIDED<\/h2>\n

2.1<\/strong> When creating an account or placing an order, the customer agrees to provide complete, accurate and up-to-date information. The customer is responsible for keeping their login details confidential and must take reasonable measures to prevent unauthorised access by third parties. <\/p>\n

2.2 <\/strong>The customer is responsible for all information and content submitted through the website and warrants that such information and content do not infringe the rights of any third party.<\/p>\n

2.3 <\/strong>Any fraudulent or abusive use of the website, or any use likely to disrupt its proper operation, is prohibited. Isadora Boutique reserves the right to suspend or delete an account in the event of fraudulent or abusive use, to the extent permitted by applicable law. <\/p>\n

2.4<\/strong> Isadora Boutique reserves the right to refuse or cancel an order for legitimate reasons, including suspected fraud, payment errors, product unavailability or the impossibility of fulfilling the order. If payment has already been made and the order cannot be fulfilled, any amounts due to the customer will be refunded. <\/p>\n

3. ORDER RECORDS AND ACCESS TO ORDERS<\/h2>\n

3.1<\/strong> These Terms may be consulted on the website at any time. The version applicable to an order is the version in force at the time the contract is concluded. <\/p>\n

3.2<\/strong> Information relating to orders is retained in accordance with applicable legal requirements. Where the customer has a customer account, they may access the information made available in their personal account area, including their order history. <\/p>\n

4. CONTRACTING PARTY<\/h2>\n

Isadora Boutique is the customer\u2019s contracting party for products sold directly through its website.<\/p>\n

5. CONTRACT LANGUAGE AND CONCLUSION OF THE ORDER<\/h2>\n

5.1<\/strong> The website and the ordering process are available in French, German, Italian and English. The contract may be concluded in any of the languages available on the website and selected by the customer. <\/p>\n

5.2<\/strong> Before submitting an order, the customer may review the contents of their shopping cart, the quantities selected and the delivery information, and may correct any input errors.<\/p>\n

5.3 <\/strong>By submitting the order and confirming the obligation to pay, the customer makes a binding offer to purchase the selected products. Receipt of the order is confirmed electronically. The sales contract is concluded when Isadora Boutique accepts the order, in particular by sending an order confirmation. <\/p>\n

5.4<\/strong> The customer must be given the opportunity to review these Terms before submitting the order. By submitting the order, the customer confirms that they have read and accepted these Terms. <\/p>\n

6. PRODUCTS<\/h2>\n

6.1<\/strong> Isadora Boutique makes every effort to describe the essential characteristics of each piece of jewellery as accurately as possible. Photographs, colours and product representations are intended to depict the jewellery as faithfully as possible. <\/p>\n

Slight differences may nevertheless occur, particularly due to lighting conditions when photographs are taken or the customer\u2019s screen settings.<\/p>\n

6.2<\/strong> The dimensions, weights and other characteristics stated on the product pages may be subject to slight variations inherent in the manufacturing process, provided that such variations do not materially affect the essential characteristics of the jewellery.<\/p>\n

7. PRICES AND DELIVERY CHARGES<\/h2>\n

7.1<\/strong> The prices applicable are those displayed on the website at the time the order is submitted. Prices are stated in Swiss francs (CHF<\/strong>). Any applicable taxes are indicated in accordance with the legal requirements applicable to Isadora Boutique. <\/p>\n

7.2<\/strong> Delivery charges are communicated to the customer during checkout, before the order is finally submitted. Delivery within Switzerland is free for orders of CHF 150 or more. <\/p>\n

7.3<\/strong> For orders shipped outside Switzerland, customs duties, import taxes, local VAT or other charges may be imposed by the authorities in the destination country. Unless otherwise required by mandatory law or expressly stated when the order is placed, these charges are not included in the price paid to Isadora Boutique and are the customer\u2019s responsibility. <\/p>\n

8. PAYMENT<\/h2>\n

8.1<\/strong> The payment methods available are those displayed during checkout. Depending on availability, these may include credit or debit cards and TWINT. <\/p>\n

8.2 <\/strong>Payments are processed by the payment service providers available on the website. Isadora Boutique shall not be held liable for any refusal or malfunction directly attributable to the payment service provider, subject to its obligations under applicable law. <\/p>\n

8.3<\/strong> An order may be suspended or cancelled if payment is refused, incomplete or cancelled, or where there are reasonable grounds to suspect fraudulent use of a payment method.<\/p>\n

9. DELIVERY<\/h2>\n

9.1<\/strong> We prepare each order with the utmost care. Orders are generally prepared and dispatched within 24 to 48 business hours<\/strong>, subject in particular to product availability and payment confirmation. <\/p>\n

9.2<\/strong> Estimated delivery times are :<\/p>\n

Switzerland : 2 to 5 business days<\/strong>
Europe : 5 to 15 business days<\/strong><\/p>\n

These timeframes are provided for guidance only and may vary depending on the destination, carrier, periods of high demand or customs formalities.<\/p>\n

9.3<\/strong> Once the order has been dispatched, the customer will receive, where the selected shipping method allows, a confirmation email containing a tracking number.<\/p>\n

9.4 <\/strong>To the extent permitted by law, Isadora Boutique shall not be held liable for delays exclusively attributable to postal services, the carrier, customs authorities or an event reasonably beyond its control. Any mandatory statutory provisions remain unaffected. <\/p>\n

9.5<\/strong> The customer is responsible for ensuring that the delivery address provided when placing the order is accurate and complete.<\/p>\n

If a parcel is returned due to an incorrect or incomplete address provided by the customer, failure to collect the parcel, or unjustified refusal to accept delivery, any additional costs actually incurred may be charged to the customer to the extent permitted by applicable law.<\/p>\n

10. EXCHANGES AND RETURNS<\/h2>\n

10.1 \u2013 Return period<\/h3>\n

Subject to the exclusions set out below and any applicable mandatory statutory provisions, the customer may request an exchange or return within a maximum of 14 calendar days from receipt of the order.<\/strong><\/p>\n

Where only Swiss law applies, this right of return is a voluntary commercial policy offered by Isadora Boutique<\/strong>, as Swiss law does not provide a general statutory right of withdrawal for online purchases.<\/p>\n

Any mandatory statutory rights that are more favourable to the customer remain unaffected.<\/p>\n

10.2 \u2013Condition of returned items<\/h3>\n

Returned items must be unworn, unused, undamaged and in their original condition, together with their original packaging and any accessories supplied with them.<\/p>\n

Under Isadora Boutique\u2019s voluntary return policy, any item that does not meet these conditions may be refused.<\/p>\n

10.3 \u2013 Earrings and piercings<\/h3>\n

For health and hygiene reasons, earrings and piercings cannot be returned or exchanged under Isadora Boutique\u2019s voluntary return policy.<\/strong><\/p>\n

They are therefore not eligible for a return, exchange or refund due solely to a change of mind.<\/p>\n

This exclusion does not affect the customer\u2019s statutory rights where an item is defective, damaged, non-conforming or different from the item ordered.<\/strong><\/p>\n

Any applicable mandatory statutory provisions remain unaffected.<\/p>\n

10.4 \u2013 How to make a return<\/h3>\n

Before returning any item, the customer must contact our customer service team at : info@isadora-boutique.ch<\/a><\/p>\n

Once the request has been approved, Isadora Boutique will provide the customer with the return address and the necessary instructions.<\/p>\n

Please do not return any item without first contacting our customer service team,<\/strong> subject to any applicable mandatory statutory rights.<\/p>\n

10.5 \u2013 Return shipping costs<\/h3>\n

Unless otherwise required by mandatory law, return shipping costs are borne by the customer.<\/p>\n

Where the return results from an error attributable to Isadora Boutique or concerns a product with a defect covered by the customer\u2019s statutory rights, the necessary return shipping costs will be covered in accordance with applicable law.<\/p>\n

10.6 \u2013 Proof of postage<\/h3>\n

We strongly recommend that the customer retain proof of postage and the tracking number <\/strong>until the return has been fully processed.<\/p>\n

To the extent permitted by law, Isadora Boutique shall not be held liable for a returned parcel that is lost before it is received, where such loss is not attributable to Isadora Boutique.<\/p>\n

11. REFUNDS<\/h2>\n

11.1<\/strong> Upon receipt of the returned item, Isadora Boutique will inspect its condition and verify that the applicable return conditions have been met.<\/p>\n

11.2 <\/strong>If the return is accepted, the refund will be issued within a maximum of 10 days following receipt of the returned item<\/strong>, using the same payment method used for the order, unless otherwise agreed or required by mandatory law.<\/p>\n

11.3<\/strong> Depending on the customer\u2019s bank, card issuer or payment service provider, additional processing time beyond Isadora Boutique\u2019s control may be required before the refund appears in the customer\u2019s account.<\/p>\n

11.4<\/strong> Where mandatory statutory provisions applicable to the customer provide for a different timeframe, amount or refund procedure, those provisions shall prevail.<\/p>\n

12. DEFECTIVE OR DAMAGED ITEMS AND ORDER ERRORS<\/h2>\n

2.1 <\/strong>The customer is encouraged to check the condition and conformity of their order upon receipt. If an item is defective, damaged, non-conforming or different from the item ordered, the customer is encouraged to contact Isadora Boutique as soon as possible at : info@isadora-boutique.ch<\/a> <\/p>\n

12.2 <\/strong>To facilitate the handling of the request, the customer is encouraged to provide the order number, the product reference, a description of the issue and, where possible, photographs showing the defect or error.<\/p>\n

12.3<\/strong> Isadora Boutique will then inform the customer of the applicable procedure and, where necessary, the arrangements for returning the product.<\/p>\n

The exclusion of returns for earrings and piercings on health and hygiene grounds does not apply to legitimate claims relating to a defective, damaged, non-conforming or incorrectly delivered product.<\/strong><\/p>\n

13. WARRANTY<\/h2>\n

13.1 <\/strong>Products sold by Isadora Boutique are covered by the rights relating to defects in the purchased goods provided for under applicable Swiss law, in particular the Swiss Code of Obligations.<\/p>\n

Any mandatory consumer protection provisions that may apply remain unaffected.<\/p>\n

13.2<\/strong> The customer is encouraged to inspect the goods as soon as reasonably possible after receipt and to report any defects in accordance with the requirements of applicable law. Defects that could not reasonably have been identified upon receipt should be reported as soon as they are discovered. <\/p>\n

13.3<\/strong> Depending on the nature of the defect and the rights available to the customer, Isadora Boutique may, in particular, arrange for a repair, replacement, price reduction or refund in accordance with applicable law.<\/p>\n

13.4 <\/strong>Subject to any mandatory statutory rights, the warranty does not, in particular, cover damage or deterioration resulting directly from:<\/p>\n
